Terms & Conditions
Basis for offers, orders and services provided by ST Cars GmbH.
Scope
- These Terms and Conditions apply to services provided by ST Cars GmbH in the areas of vehicle service, repairs, diagnostics, tyre and wheel service, suspension, tuning, MFK preparation and related services.
Offers and conclusion of contract
- Offers from ST Cars GmbH are non-binding unless stated otherwise. An order is concluded when the customer confirms the service or hands over the vehicle for execution of the agreed work.
Vehicle acceptance and customer information
- The customer is obliged to fully disclose relevant information about the vehicle, known defects, previous work, special modifications and existing damage. ST Cars GmbH documents the vehicle condition upon acceptance where possible.
Diagnostics and cost estimates
- Diagnostics and cost estimates are carried out according to best professional knowledge. Additional defects may become visible during the work. In such cases, ST Cars GmbH informs the customer about recommended additional work and obtains approval where possible.
Spare parts and customer-supplied parts
- ST Cars GmbH uses suitable spare parts based on professional assessment. Parts supplied by the customer may be used after inspection. ST Cars GmbH accepts no responsibility for quality, fitment or consequential damage caused by customer-supplied or unsuitable parts, to the extent permitted by law.
Appointments and execution times
- Appointments and execution times are planned carefully. Delays may occur due to spare part availability, additional defects, third-party suppliers or technical complexity. ST Cars GmbH informs the customer in the event of significant delays.
Test drives
- The customer agrees that ST Cars GmbH may carry out test drives where required for diagnostics, quality control or verification of completed work.
MFK preparation
- ST Cars GmbH prepares vehicles for the official MFK inspection according to best professional knowledge. Successful MFK approval cannot be guaranteed, as assessment is carried out by the competent inspection authority.
Tuning, suspension and technical modifications
- For tuning, lowering, suspension work and technical modifications, responsibility for legal admissibility, registrations, documents and approvals lies with the customer unless expressly agreed otherwise. ST Cars GmbH advises according to best professional knowledge.
Prices and payment
- Prices are stated in Swiss francs. Unless agreed otherwise, invoices are due upon vehicle collection or according to the invoice terms. ST Cars GmbH may request advance payments, especially for larger orders or special parts.
Vehicle collection and storage fees
- The customer will be informed once the vehicle is ready for collection. If the vehicle is not collected within a reasonable period after notification, storage fees may be charged. The amount and start date of storage fees must be communicated to the customer in advance.
Warranty
- Work performed and installed parts are subject to statutory provisions and any manufacturer warranties. Damage caused by improper use, subsequent third-party interventions, motorsport, excessive stress or unsuitable parts supplied by the customer is excluded to the extent permitted by law.
Liability
- ST Cars GmbH is liable for damage caused by intentional or grossly negligent breach of duty. Further liability is excluded to the extent permitted by law.
Data protection
- Personal data is processed for handling requests, carrying out orders, communication and invoicing. Further information is provided in the Privacy Policy.
Applicable law and jurisdiction
- Swiss law applies. The place of jurisdiction is, to the extent permitted by law, the registered office of ST Cars GmbH.
Final provisions
- Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic purpose.
